Payment Channels and Methods

Our payment policy has been designed to ensure absolute clarity while offering a range of strategic advantages to our valued users. Pre-authorized Debit (PAD)
Upon the successful completion of each transaction, customers will receive a valuable cash voucher, equivalent to 1% of the post-tax transaction amount. These cash vouchers are redeemable for future purchases at FoodsUp Inc.

Cash Voucher Reward
1. The 1% cash voucher amount will be calculated based on the order's delivery amount after taxes have been applied.
2. Cash voucher will be sent to your app account wallet
3. The cash voucher is valid for 180 days from the date it is issued.
4. You can use the cash voucher in conjunction with other discounts.
5. Cash vouchers from payments cannot be accumulated for use on a single order. Each voucher is intended for individual use on future purchases.

Privacy and Data Security
PAD Service on FoodsUp is enabled by a data-driven payment transformation service provider, Vopay. We want to assure you that your privacy and the security of your personal information are of utmost importance to us. In conjunction with the Services provided , Vopay may process personal information in accordance with agreements and lawful instructions. When providing these services, Vopay may collect the following categories of personal information about users:

a) Transaction Data
:If you make or receive payments or funds from FoodsUp, Vopay will receive transaction data. This may include your name, email address, billing address, shipping address, payment method information (such as credit or debit card number, bank account information),merchant and location, purchase amount, date of purchase, and, in some cases, information about what you have purchased, your phone number, and past purchases.

b) Financial and Identification Information:
Vopay may collect information from banking and accounting software, including client verification services. In connection with this, Vopay may collect government identification, account information, and historical transaction data.

You are always available to make a written request to review any personal information about you that Vopay have collected, used or disclosed, and Vopay will provide you with any such personal information to the extent required and/or permitted by law.

Withdrawing Consent
You may withdraw your consent to Vopay's collection, use or disclosure of your personal information at any time by contacting Vopay using the contact information in the “Contact Us” section of Vopay official website. However, note that: withdrawal of your consent may prevent you from using PAD on the FoodsUp App.

Before Vopay implements the withdrawal of consent, they may require proof of your identity; and even if you withdraw your consent, Vopay may keep using, disclosing or retaining some of your personal information to the extent required by applicable law.

Updating Payment Information
Please provide written notice to FoodsUp at cs@foodsup.com for any payment address changes or PAD agreement cancellations.

Disclaimer of warranties
You expressly understand and agree that:
a) Your use of data-driven payment transformation service and all information, products and other content (including that of third parties) included in or accessible from the data-driven payment transformation service is at your sole risk. The data-driven payment transformation service is provided on an “as is” and “as available” basis. FoodsUp and its service providers expressly disclaim all warranties of any kind as to the data-driven payment transformation service and all information, products and other content (including that of third parties) included in or accessible from the data-driven payment transformation service, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

b) FoodsUp and its service providers make no warranty that (i) the data-driven payment transformation service will meet your requirements, (ii) the data-driven payment transformation service will be uninterrupted, timely, or error-free, (iii) the quality of any products, services, information, or other material purchased or obtained by you through the data-driven payment transformation service will meet your expectations, or (iv) any errors in the technology will be corrected

c) Any material downloaded or otherwise obtained through the use of the data-driven payment transformation service is done at your own discretion and risk and you are solely responsible for any damage to your computer system or loss of data that results from the download of any such material. No advice or information, whether oral or written, obtained by you from FoodsUp or its service providers through or from the data-driven payment transformation service will create any warranty not expressly stated in these terms.

Limitation of liability
You agree that neither FoodsUp or its service providers nor any of our and their affiliates, account providers or any of our and their affiliates will be liable for any harms, which lawyers and courts often call direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, even if FoodsUp or its service providers have been advised of the possibility of such damages, resulting from:
a) the use or the inability to use the data-driven payment transformation service;
b) the cost of getting substitute goods and services,
c) any products, data, information or services purchased or obtained or messages received or transactions entered into, through or from the data-driven payment transformation service.
d) unauthorized access to or alteration of your transmissions or data;
e) statements or conduct of anyone on the data-driven payment transformation service;
f) the use, inability to use, unauthorized use, performance or non-performance of any third-party account provider site, even if the provider has been advised previously of the possibility of such damages; or
g) any other matter relating to the data-driven payment transformation service.

You agree that FoodsUp and its service providers, and any of our and their affiliates (and our and their respective employees, directors, agents, and representatives) will not be liable for any indirect, incidental, punitive, or consequential damages arising out of or in connection with the transactions, the Payments (including the payments materials), the Service (including without limitation the inability to use the services), or any application using our services.

Cancellations
Your PAD Agreement may be canceled provided written notice is received by the District of Mission’s Finance Department by the 5th of the month, which is 10 days before the next scheduled PAD withdrawal.

Changes
It is your responsibility to notify the Finance Department in writing, by the 5th of the month, of any changes to the banking information that your payments are debited from.

Renewals
Your PAD monthly withdrawal amount will automatically renew each year and will be adjusted to reflect the estimated following year’s utilities and taxes, unless predetermined. The withdrawal estimate for subsequent years will include any outstanding balance from the prior year.Renewals are discontinued if your tax account is in the delinquent status.

Dishonored payments
All dishonored payments will be subject to a service charge (currently $35.00). The service charge may increase in the future without notice.
Participation in the PAD Plan will automatically cease if two (2) pre-payments (not necessarily consecutive) fail to be honored by your financial institution.
Interest will not be accrued on payments returned by your bank.

Offline Payments: POS Machine Card Swipe (Visa, Mastercard, etc.) / Cash / Check Payment

No Additional Payment Channel Fees
No supplementary payment channel fees are imposed for any transactions conducted using POS machines, cash, or checks.

No Cashback Voucher
No cashback vouchers are associated with offline payment methods.

Online Payments: Through Third-Party Payment Channels (Visa / Mastercard / Apple Pay, etc.)

Payment Channel Fee
To cover the expenses incurred in processing online payments made through third-party channels such as Visa, Mastercard, and Apple Pay, a payment channel fee of 2% of the post-tax order amount will be applied.

Shipping & Handling

Free Next-Day Delivery
1. FoodsUp offers complimentary next-day delivery for all orders, except on Sundays.
2. Orders confirmed on day (00:00-23:59) will be delivered the next day between 8:00-23:00, in accordance with your restaurant's working hours as indicated on Google Maps.
3. No delivery service is available for residential addresses. We only deliver to restaurant addresses.

Cash On Delivery
Cash on delivery is available for any completed order.

Self Pickup
We only accept online payments for self-pickup orders.

Small Order Handling Fee
1. No small order handling fee will be charged for any completed order equal to or exceeding $100 (before tax).
2. For any completed order amounting to less than $100 (before tax), a small order handling fee of $9.90 (tax included) will be applied.
3. If a product is returned and the order total falls below $100 (before tax), a small order handling fee will be deducted from the refund amount.
4. Small order handling fee will be exempted if users are unable to meet the $100 order requirement due to product unavailability or refund for catch weight products.

Order Cancellation
1. You may cancel your orders on the same day of purchase (before 23:59 PM) by contacting our Customer Service. In such cases, the entire order amount, including the small order handling fee, will be refunded.
2. For cancellations made on the next day (from 00:00 AM onwards), a small order handling fee will be applied to cover processing and preparation costs.
3. FoodsUp Inc. reserves the right to decline your order, and in such cases, a refund will be issued..

Order Cancellation
